2. This 'Property Search Service' (Service) is a service provided by P.E. Analytics Private Limited (Service Provider). The Service Provider has a website which provides information relating to real estate across India. The Service Provider has offered the Service to the users of www.hsbc.co.in (Website) which belongs to The Hongkong and Shanghai Banking Corporation Limited, India (HSBC India). The usage of the Service is voluntary.
3. The Service will be available for use in India only.
4. To avail the Service an individual visiting the Website (User) may be required to give personal information and certain other details online to the Service Provider. For sake of clarity, it is hereby confirmed that only on providing the required details, will the User be considered to be eligible for availing this Service.
5. The Services provided by "Service Providers' are rendered within 7 cities in India only namely Delhi, Chandigarh, Ahmedabad, Mumbai, Pune, Bangalore and Chennai.
6. HSBC India is not making any offer and does not make any warranties or representation about the quality, merchantability, suitability or availability of the Service or about the Service Provider. All disputes in this regard should be taken up directly by the User with the Service Provider. HSBC India is not liable for any defect or deficiency in the Service obtained /availed under this program and all disputes in this regard should be taken up by the User with the Service Provider.
7. This Service does not constitute investment advice or a solicitation of an offer to purchase or subscribe for the Service. HSBC is not making any offer and does not make any warranties or representations about the quality, merchantability, suitability or availability of the housing units advertised by the Service Provider on its website. HSBC has not verified the information provided under this Service and the User should undertake the necessary due diligence prior to finalizing any transactions. HSBC is not liable for any defect or deficiency in the housing units advertised by the Service Provider on its website. HSBC will not be held responsible for any delay or disputes in respect of the Service. All disputes in this regard should be taken up by the User with the Service Provider directly.
8. HSBC shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered, as a result of availing the Service.
9. Any dispute arising out of or in connection with this Service shall be subject to the exclusive jurisdiction of the courts in Mumbai only. The existence of a dispute, if any, shall not constitute a claim against HSBC India.
10. By availing of the service, the Users shall be deemed to have accepted these Terms and Conditions in totality.
