Enhanced Partnership Program (“EPP”) implemented by Samsung India Electronics Pvt. Ltd. (“SIEL”) is a programme extended to select customers/ employees of The Hongkong and Shanghai Banking Corporation Ltd (HSBC) having valid HSBC credit and debit cards (“EPP users”) providing access to Samsung products (“Products”) on such microsite/weblink as intimated by Samsung.
The sale transaction is between the EPP users and SIEL. All sales are subject to terms and conditions of Samsung Estore.
Access to EPP is provided to EPP users on the following terms and conditions and the participating company agrees to share the following terms and conditions to its EPP users to comply with:
- EPP users must be an active holder of relevant bank cards of the participating company to gain access to the EPP site. EPP users’ Bin details will be validated with the participating company. In the event SIEL requires any additional or updated information, the participating company shall provide the necessary assistance to SIEL.
- Access to EPP and the benefits provided to EPP users is at the sole discretion of SIEL and is subject to change at any time without prior notice. EPP users are subject to purchasing quotas for each product. EPP quota limits apply for calendar year periods and will refresh at the beginning of each calendar year (1 January to 31 December of each year)
- Purchase of the product is limited to the use of the eligible EPP user, their family and friends. Re-sale of the products is strictly prohibited and will be treated as a breach of EPP benefits.
- EPP users are not allowed to expose EPP discount price information by sharing log-on credentials with outsiders.
- EPP purchase users are not allowed to resell, export, or transfer the purchase to any third party. On-selling of devices will be strictly monitored by SIEL. Product serial numbers are recorded and SIEL reserves the right to track and trace any products sold through EPP for the purposes of monitoring compliance with these terms and conditions.
- EPP users shall not publish any EPP information, promotion and any marketing material, any prices or discounts offered to the EPP user under EPP in any medium (including on social media or any online platforms) or otherwise disclose to any person (other than a family member). In particular, EPP users shall not disclose such information to any retail partners or business partners of SIEL and shall not request that EPP prices are matched by such retail partners or not even disclose to any third party.
- Offers, benefits or promotions offered by SIEL separately from EPP may not be available to EPP users in conjunction with an EPP purchase.
- SIEL shall reserve the right, without any prior notice to terminate or suspend or invalidate access or discontinue the eligibility of any person who uses EPP, if EPP user do not comply or breach or SIEL suspects that EPP user fails to comply any terms of use www.samsung.com/in/shop-terms-of-use/. In addition, SIEL shall reserve the right to take any legal action against any person in EPP as it deems necessary at its sole discretion to recover any damages from such person to the fullest extent as permitted by applicable law.
- SIEL reserves the right to revise or change or amend these terms and conditions without prior notice to the extent permitted by law. In no event shall SIEL be liable for any claims, costs or damages caused by arising such changes or revision or amendments.
- Any disputes regarding EPP or eligibility for EPP or EPP user’s compliance with these terms and conditions will be resolved by SIEL in its sole discretion. SIEL’s decision is final and no further correspondence or appeal will be entertained.
- By participating in this EPP, EPP users accept all responsibility for and hereby release and agrees to indemnify and hold SIEL harmless from and against any claims, liability, damages or expenses that may arise from participating in this EPP.
- EPP users have read, understood and accept Samsung’s Privacy Policy www.samsung.com/in/info/privacy/ and give absolute consent to SIEL to store and process the personal data for EPP at the sole discretion.
- These terms and conditions herein shall be governed by and interpreted in accordance with laws of India and the parties will submit to the exclusive jurisdiction of the courts in Delhi, India.
- HSBC does not make any warranties or representations as to the quality, merchantability, suitability or availability of the products or services offered by Samsung pursuant to this EPP. Any dispute regarding delivery, service, suitability, merchantability, availability or quality of the products/services availed under this EPP must be addressed directly to SIEL by the customer as per the terms of purchase with Samsung.
